Understanding Land Use Restrictions & Securing Entitlements for Building in Northwest Montana

Land use restrictions and entitlements are frequently overlooked pre-construction challenges that require significant time and effort to secure before building. Properties in Montana may be subject to use constraints related to wetlands, water protection, on-site wastewater limitations, floodplains, etc. Finmark Construction has the knowledge and resources to assist prospective homeowners in identifying and navigating entitlements.

A few considerations and questions for prospective land purchases in our area include:

  1. On-site wastewater treatment: Does the property have a prior Septic Site Evaluation or a COSA (Montana DEQ Certificate of Subdivision Approval) for on-site wastewater treatment? If so, what does it entitle or limit? These frequently have limitations on the number of structures and use type and may need to be rewritten to accomplish particular build objectives such as multiple dwellings.
  1. Zoned Properties: Is the property in a zoned area, and what building restrictions are imposed by zoning? Common restrictions include limitations on building height and location on a given property by way of minimum setbacks. 
  1. Floodplain and/or Lakeshore Protection: Is the property near a floodplain, stream, river, or lakeshore? Projects impacting floodplains and shore areas are subject to specific design limitations and unique permitting. Finmark Construction has experience administering projects in areas designated as floodplain and/or protected under Flathead County’s Lakeshore Protection Zone.
